Definition of Employee Status
“EMPLOYEES” DEFINED
An “employee” of AVIALITE is a person who regularly works for AVIALITE on a wage or salary basis. “Employees” may include Executive, Non-Executive, regular full-time, regular part-time, and temporary persons, interns and others employed with the Company who are subject to the control and direction of AVIALITE in the performance of their duties.
EXECUTIVE
Employees whose positions meet specific criteria established by the Company and who are exempted from overtime pay requirements. There are three categories under which an employee may be considered. They are administrative, executive, and professional. These categories generally define an exempt employee as one who customarily and regularly exercises discretion and independent judgment in the performance of his/her duties.
Administrative exemption is for non-manual or office work directly related to management policies or general business administration. Positions customarily and regularly exercise independent judgment and discretion more than 50% of the time. Work is performed under general supervision and may require special training, experience, or knowledge.
The Executive exemption is for positions whose primary duty is management of a department or subdivision in addition to exercising independent judgment and discretion more than 50% of the time. Under the executive exemption, positions must either directly supervise 1 or more full-time employees or have the ability to make employment and work decisions.
The Professional exemption is for work that requires an advanced degree and that is original or creative in nature. Independent judgment and discretion must be excercized in these positions more than 50% of the time.
NON-EXECUTIVE
Employees whose positions do not meet the above criteria and who are paid one and one-half their regular rate of pay for hours worked in excess of 40 hours per week.
REGULAR FULL-TIME
Employees who have completed the probationary period and who are regularly scheduled to work 40 or more hours per week. Generally, they are eligible for the Company’s benefit package, subject to the terms, conditions, and limitations of each benefit program
REGULAR PART-TIME
Employees who have completed the probationary period and who are regularly scheduled to work less than 35 hours per week. Regular part-time employees are eligible for some benefits sponsored by the Company, subject to the terms, conditions, and limitations of each benefit program.
CONTRACT
(FULL-TIME)
Those whose performance is being evaluated to determine whether further employment in a specific position or with the Company is appropriate or individuals who are hired as interim replacements to assist in the completion of a specific project or time frame (subject to renewal).Generally, they are eligible for the Company’s benefit package, subject to the terms, conditions, and limitations of each benefit program.
TEMPORARY (FULL-TIME or PART-TIME) / INTERNSHIP
Those whose performance is being evaluated to determine whether further employment in a specific position or with the Company is appropriate or individuals who are hired as interim replacements to assist in the completion of a specific project or for vacation relief or is undergoing internship programme with the Company. Employment beyond any initially stated period does not in any way imply a change in employment status. Temporary employees / interns retain that status until they are notified of a change. They are not eligible for any of the Company’s benefit programs.
PROBATIONARY PERIOD FOR NEW EMPLOYEES
A new employee whose performance is being evaluated to determine whether further employment in a specific position or with AVIALITE is appropriate. When an employee completes the probationary period, the employee will be notified of his/her new status with AVIALITE.
RE-EMPLOYMENT
An employee who had resigned may re-apply to join back AVIALITE if a suitable vacancy is available while the employee has a satisfactory performance track record in AVIALITE and will be treating as a new employee without take consideration from previous employment when computing leave entitlement and other benefits.
